Beginning July 1, 2017, all Department of Workers’ Claims (DWC) submissions must be made in electronic format via the DWC’s Litigation Managment System (LMS).  However, due to the ongoing development of the capacity of the LMS to receive and process settlement agreements in electronic format, the DWC will continue, until further notice, to accept Form 110 Settlement Agreements in paper format subsequent to July 1, 2017.

electronic-filingThe DWC has announced that per 803 KAR 25:010 Section 3(1)(b), effective July 1, 2017, it will no longer accept paper filings.  All filings will need to be submitted via Litigation Management System LMS.

The Kentucky DWC’s proposed online litigation management system (LMS) is in the works and is expected to be functioning at least as a beta version some time in the near future.  It has encountered some hurdles from members of the workers’ compensation bar resistant to this much needed change in the administration of workers’ compensation claims.  Hopefully those dissident voices will be eventually ignored so that this necessary technology can be launched.
